1. What SpeakRise is
SpeakRise is a tool for practising spoken English against an AI persona, and for getting written feedback afterwards. It is practice, and nothing more than that:
- It is not a language certification. Our scores are our own, they are not CEFR, TOEFL, IELTS or any recognised standard, and no employer or institution is obliged to care about them.
- It is not a teacher and not a substitute for one.
- It does not promise you a job, an interview, or any outcome in the real conversation you are preparing for.
2. The AI, and what it gets wrong
The persona’s replies, the transcription of your speech, and your evaluation are all generated by AI systems. They will sometimes be wrong. Transcription mishears accents. Scores are a judgement, not a measurement. The persona can say things that are inaccurate.
Treat all of it as practice material, not as advice. Nothing SpeakRise produces is professional advice of any kind — career, legal, medical, financial or otherwise — and you should not act on it as if it were.
3. Your account
- You must be at least 13 years old, and if you are under 18 you need a parent or guardian’s permission.
- Give us accurate information, and keep your email address current — it is how we reach you.
- One account per person. Creating extra accounts to collect the free credit offer more than once is a breach of these terms.
- You are responsible for your password and for what happens under your account. Tell us promptly if you think someone else has access.
4. Credits
Sessions and other features are paid for with credits. A few things follow from that:
- Different features cost different amounts. The current cost is always shown in the app before you spend anything.
- Credits are debited when a feature runs, because that is when the underlying services actually cost us money.
- Credits are not money. They have no cash value, cannot be exchanged for cash, and cannot be transferred to another account.
- The free credits we grant on sign-up are a promotional offer. We can change or withdraw the offer for new accounts at any time; doing so does not remove credits already granted to you.
- Buying credits is not available yet. When it becomes available, the payment, refund and cancellation terms will be published here before any purchase is possible.
- If a feature fails through our fault and you were charged for it, tell us and we will credit you back.
5. Acceptable use
Do not:
- upload audio of anyone who has not agreed to it — record yourself, not other people;
- use SpeakRise to produce or rehearse anything illegal, hateful, harassing, or sexual involving minors;
- put other people’s confidential information into session context — remember that what you paste is sent to our AI processors;
- use bots, scripts or scrapers against the service, or try to get around credit costs, rate limits or session limits;
- attempt to break, overload or probe the security of the service, or access another user’s data;
- resell or rebrand the service as your own.
6. Your content, and ours
What you record and write stays yours. You give us only the permission we need to actually run the product: to store your recordings and text, send them to the processors listed in our Privacy Policy, and generate your transcripts, replies and evaluations. That permission ends when you delete the content or your account.
The application itself — the software, the interface, the evaluation rubric, the SpeakRise name and logo — stays ours.
7. Availability
We run SpeakRise on a best-effort basis. There is no uptime guarantee. Features can change, and we may add, alter or remove them. If we ever discontinue the service, we will give account holders reasonable notice by email and a chance to export their reports.
8. Suspension and termination
You can stop using SpeakRise whenever you like, and ask us to delete your account as described in the Privacy Policy.
We may suspend or close an account that breaches these terms — particularly section 5, or multiple accounts farming the free offer. Where it is reasonable to do so, we will warn you first. Credits on a closed account are forfeited.
9. Liability
SpeakRise is provided as it is, without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential loss, or for any outcome of a real conversation you prepared for here. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the previous twelve months, or ten US dollars.
Nothing here limits liability that cannot lawfully be limited — including, for consumers in Brazil, rights under the Código de Defesa do Consumidor.
10. Changes to these terms
We may update these terms. The date at the top always reflects the current version, and we will notify account holders by email before a material change takes effect. Continuing to use SpeakRise after that means you accept the new version.
11. Governing law
These terms are governed by the laws of Brazil, and disputes belong to the courts of São Paulo, without prejudice to any right you have as a consumer to bring proceedings where you live.
